LIABILITY WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

By participating in any services, sessions, or activities offered by Unwind Sound Lounge (“USL”), I acknowledge and agree as follows:

1. Voluntary Participation

I understand that I am voluntarily participating in services and experiences offered by USL, including but not limited to vibroacoustic sound therapy, meditation, sound immersion, infrared light therapy, relaxation therapies, aromatherapy, sensory experiences, and related wellness services (collectively, the “Services”).

2. Assumption of Risk

I understand that participation in the Services involves inherent risks, known and unknown, which may include, without limitation:

  • Physical discomfort, dizziness, nausea, fatigue, or injury

  • Emotional release or psychological responses

  • Aggravation of pre-existing physical or mental health conditions

  • Reactions to sound, vibration, light exposure, aromatherapy, compression, or sensory stimulation

  • Equipment malfunction or misuse

I knowingly and voluntarily assume all risks associated with participation in the Services, including risks that may arise from the ordinary negligence of USL or its owners, employees, contractors, agents, or representatives.

I understand that I may immediately stop participation at any time if I experience discomfort or distress.

3. No Medical Advice

I understand and agree that USL does not provide medical advice, diagnosis, or treatment. The Services are provided solely for wellness, relaxation, educational, and recreational purposes and are not intended as a substitute for professional medical or mental health care.

I understand that no specific outcomes or results are guaranteed.

I acknowledge that it is my responsibility to consult with a licensed physician or healthcare provider prior to participating if I have any medical or psychological concerns.

4. Health Acknowledgment & Contraindications

I affirm that I am physically and mentally capable of safely participating in the Services.

I understand that participation may not be appropriate for individuals with certain conditions, including but not limited to:

  • Pacemakers or implanted electronic devices

  • Severe cardiovascular conditions

  • Epilepsy or seizure disorders

  • Deep vein thrombosis (DVT) or serious circulation conditions

  • Pregnancy, particularly during the first trimester

  • Recent surgeries, fractures, or open wounds

  • Severe psychiatric conditions, including active psychosis

  • Acute illness, infection, fever, or inflammation

I agree to disclose any relevant medical conditions to USL prior to participation.

5. Release and Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS USL, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, AND REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, OR EXPENSES OF ANY KIND ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE SERVICES OR USE OF THE FACILITIES OR EQUIPMENT, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, PROPERTY DAMAGE, DISABILITY, OR DEATH, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

6. California Civil Code Section 1542 Waiver

I expressly waive and relinquish all rights and benefits under California Civil Code Section 1542, which states:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

I understand and acknowledge the significance of this waiver.

7. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to my participation in the Services, my conduct, or my violation of this Agreement.

8. Use of Equipment

I agree to use all equipment, including sound lounge beds, headphones, eye masks, blankets, and related accessories, only as instructed by USL staff. I accept responsibility for any damage or injury resulting from misuse of equipment.

9. Personal Property

I understand that USL is not responsible for lost, stolen, or damaged personal property.

10. Studio Policies & Conduct

I agree to comply with all studio policies, safety instructions, and staff directions. USL reserves the right to refuse or discontinue Services to any individual whose conduct is unsafe, disruptive, or inappropriate, without refund.

11. Governing Law; Severability

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Acknowledgment and Electronic Signature

I acknowledge that:

  • I have carefully read and fully understand this Agreement

  • I understand that I am waiving certain legal rights

  • I am voluntarily agreeing to these terms

  • I am at least 18 years of age, or a parent/legal guardian is signing on my behalf

By typing my name and submitting this form, I acknowledge that I am electronically signing this Agreement and voluntarily accepting the terms of this Liability Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement.
